Terms for purchases, commissions, and use of this website

These terms govern your use of Sculptvichaar and any purchase, commission, or enquiry you make through the platform. By browsing, registering, or placing an order, you agree to these terms.

3. Eligibility and account registration

You must be at least 18 years old and capable of forming a legally binding contract under the Indian Contract Act, 1872 to use this platform. If you are a minor, you may only use the platform through a parent or legal guardian.

3.1 Account responsibilities

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your password.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorised use of your account.
  • We may suspend or terminate your account if you breach these terms or engage in fraudulent activity.

4. Product listings and descriptions

We make every effort to ensure product descriptions, images, dimensions, and materials are accurate. However:

  • Sculptures are handcrafted — slight variations in colour, texture, and finish are natural and expected.
  • Images may appear differently depending on your screen settings.
  • Product availability is subject to change. A work marked as available may become unavailable before your order is confirmed.
  • Dimensions and weights shown are approximate and may vary by up to 5%.
  • Archive/sold works are shown for reference and may be available as similar-piece commissions.

5. Pricing and payment

5.1 Pricing

  • All prices are displayed in Indian Rupees (₹) and are inclusive of GST.
  • Prices include applicable taxes but may not include shipping (shown at checkout).
  • We reserve the right to change prices at any time. The price at the time of order confirmation is the price you pay.
  • For quote-based and commission works, the price is confirmed in writing before you pay.

5.2 Payment methods

We accept payments through Razorpay, which supports credit cards, debit cards, UPI, net banking, and wallets. For large, fragile, or international orders, we may offer a manual review payment mode.

We do not store your card number, CVV, or net banking credentials. All payment data is processed securely by Razorpay.

6. Order acceptance and confirmation

Placing an order is an offer to purchase. An order is confirmed only when:

  1. Payment is successfully received (for Buy Now works).
  2. The studio reviews and accepts your commission or quote request (for custom work).
  3. You receive an order confirmation email with your order number.

We reserve the right to refuse or cancel any order before confirmation — for example, if the work is no longer available, if there is a pricing error, or if the shipping destination cannot be served. In such cases, any payment made will be refunded in full.

7. Shipping and delivery

Delivery timelines vary by work — ready-to-collect pieces dispatch after payment confirmation, while made-to-order and commissioned pieces follow the lead time shown on the product page or agreed in your commission brief.

8. Cancellations

You can cancel an order before it has been dispatched or before production has begun (for custom work). Cancellation after dispatch or production start may not be possible.

9. Returns, refunds, and exchanges

Ready-to-ship works can be returned within 14 days of delivery. Custom, commissioned, and made-to-order pieces are generally non-returnable once production begins.

10. Commissions and custom work

When you submit a commission or custom request:

  1. You provide a brief describing the sculpture, including size, material, finish, and any reference images.
  2. The studio reviews your request and may contact you to refine details.
  3. The studio shares a final quote including price and estimated lead time.
  4. You pay securely through the platform to place the order.
  5. Production begins after payment confirmation.
Commissioned and made-to-order works are non-refundable once production has begun. If you need to cancel, do so before production starts (see Cancellation Policy).

11. Intellectual property

11.1 Our content

All content on this platform — including sculpture designs, product images, descriptions, studio stories, the Sculptvichaar logo, and the overall look and feel — is owned by SARCARE MARKETING PRIVATE LIMITED or its licensors and is protected under Indian copyright law, the Copyright Act, 1957, and applicable international treaties.

11.2 Your content

When you upload reference images, commission briefs, or reviews, you grant SARCARE MARKETING PRIVATE LIMITED a non-exclusive, royalty-free licence to use, display, and reproduce that content for the purpose of fulfilling your request and operating the platform. You confirm that you own or have permission to share any content you upload.

11.3 Takedown

If you believe any content on the platform infringes your copyright, please contact our Grievance Officer with details of the infringing content and proof of ownership. We will act on valid takedown requests within 36 hours as required by the IT (Intermediary Guidelines) Rules, 2021.

12. User conduct and prohibited use

You agree not to:

  • Use the platform for any unlawful, fraudulent, or harmful purpose.
  • Post fake reviews or misrepresent the quality of any work.
  • Impersonate another person or entity.
  • Attempt to gain unauthorised access to the platform, its database, or other users' data.
  • Use bots, scrapers, or automated tools to extract data from the platform.
  • Reproduce, copy, or distribute sculpture images or designs without permission.
  • Post content that is defamatory, obscene, offensive, or infringes someone else's rights.
  • Manipulate search results, reviews, or ratings.

Violation of these rules may result in account suspension, order cancellation, and legal action where appropriate.

13. Reviews and user-generated content

You may submit reviews for works you have purchased. Reviews must be honest and based on your actual experience. We reserve the right to moderate, edit, or remove reviews that are:

  • Fake or submitted by someone who did not purchase the work.
  • Offensive, defamatory, or irrelevant.
  • Promotional or contain links to external sites.
  • In violation of any law or third-party rights.

14. Limitation of liability

To the maximum extent permitted by law, SARCARE MARKETING PRIVATE LIMITED shall not be liable for:

  • Indirect, incidental, or consequential damages arising from your use of the platform.
  • Delays in shipping or production beyond our reasonable control (force majeure).
  • Slight variations in handcrafted sculptures as described in Section 4.
  • Any loss caused by third-party service providers (payment gateways, shipping partners).
  • Any unauthorised access to your account due to your failure to protect your password.
Statutory rights: Nothing in these terms limits or excludes your statutory rights as a consumer under the Consumer Protection Act, 2019. If a sculpture is defective or does not match the description, you are entitled to a remedy regardless of these terms.

15. Indemnification

You agree to indemnify and hold SARCARE MARKETING PRIVATE LIMITED, its directors, officers, and employees harmless from any claim, demand, or damage (including reasonable legal fees) arising from:

  • Your breach of these terms.
  • Your violation of any law or third-party rights.
  • Content you upload to the platform (including reference images for commissions).
  • Any fraudulent or unauthorised activity from your account.

16. Governing law and jurisdiction

These terms are governed by and construed in accordance with the laws of India. Any dispute arising from or relating to these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.

17. Dispute resolution

Before approaching a court, we encourage you to contact our Grievance Officer (Section 20) to attempt informal resolution. If the dispute cannot be resolved within 1 month, you may file a complaint with:

Consumer Disputes Redressal Forum

Under the Consumer Protection Act, 2019, you can file a complaint with the District Consumer Disputes Redressal Forum having jurisdiction over your area, or through the Online Consumer Complaint portal at consumerhelpline.gov.in.

18. Suspension and termination

We may suspend or terminate your access to the platform at any time if:

  • You breach these terms or engage in fraudulent activity.
  • We are unable to verify information you provided.
  • Your actions may cause legal liability for us, other users, or third parties.
  • You violate applicable laws or third-party rights.

You may delete your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately.

19. Amendments to these terms

We may update these terms from time to time. Material changes will be notified via email (if you have an account) or through a website banner at least 30 days before taking effect. Your continued use of the platform after the effective date constitutes acceptance of the updated terms.

20. Grievance Officer

Under the Information Technology (Intermediary Guidelines) Rules, 2021, and the Consumer Protection (E-Commerce) Rules, 2020, we have appointed a Grievance Officer:

21. Privacy policy

Your use of the platform is also subject to our Privacy Policy, which is a separate document compliant with the Digital Personal Data Protection Act, 2023.
